Personal data protection policy

This document describes an approach used by BaccS (registered office at 2nd Novosadskaya, 38, 225710 Pinsk, Republic of Belarus) (acting as data controller) in terms of data collecting and protection.

Types of Data collected

At the moment of purchase of desktop or web version, we get information needed to generate license code for the software: your name and surname; company name; email address. You enter this information during payment on the page of our payment processor: 2checkout company.

All Data requested by this Application is mandatory and failure to provide it will make it impossible for this Application to provide its services. However, users are free not to communicate this Data, but in this case it won't be possible to generate license code and provide services.
Users who are uncertain about which Personal Data is mandatory are welcome to contact the Owner.

Place of storing and processing your Personal data

We store your Personal data on our servers in Belarus and Germany.

Way of Personal data usage?

Your Personal data is used only to generate license code. We do not send any e-mail newsletters nor use your data for any marketing campaigns. We may use your e-mail only to contact you by our initiative in urgent case. This urgent case occurs when you agree to send bug reports to BaccS server (in the program settings), and we’d like to ask additional questions about caught bug. There are no any other cases when we may use your personal data.

Legal basis of processing

The Owner may process Personal Data relating to Users if one of the following applies:

  • Users have given their consent for one or more specific purposes. Note: Under some legislations the Owner may be allowed to process Personal Data until the User objects to such processing ("opt-out"), without having to rely on consent or any other of the following legal bases. This, however, does not apply, whenever the processing of Personal Data is subject to European data protection law;
  • provision of Data is necessary for the performance of an agreement with the User and/or for any pre-contractual obligations thereof;
  • processing is necessary for compliance with a legal obligation to which the Owner is subject;
  • processing is related to a task that is carried out in the public interest or in the exercise of official authority vested in the Owner;
  • processing is necessary for the purposes of the legitimate interests pursued by the Owner or by a third party.
In any case, the Owner will gladly help to clarify the specific legal basis that applies to the processing, and in particular whether the provision of Personal Data is a statutory or contractual requirement, or a requirement necessary to enter into a contract.

Retention time

Since license code for the software is provided for lifetime period, we will always keep your personal data, to be able to restore your license key in case you loose it.

In addition, due to national legislation, we must keep all invoices and contracts during at least 7 years since the day of issuance. However, this information is stored not electronically, but in a hard copy.

You may send us a request to delete your personal data. However, in this case we won’t be able to send you a license key if you loose it.

Parties who has access to your Personal data

Your personal data will be accessible only to BaccS developer.

Cases when your Personal data can be transferred outside of their place of storage

We don’t share your personal data with anyone so it can’t be transferred.

Web-version considerations

When a company purchases BaccS web-version, this company becomes data processor, who may acquire and store personal data of its vendors. We encourage our customers to create users for each vendor, so you should be able to log on into your personal area and make any changes in your personal information.

When you know that your personal information is stored in a database of BaccS customer, you're eligible to require that customer to create a user for you for accessing, editing and deleting personal information.

Ways of protecting your Personal data

Most of data is stored on a computer which is not accessible from Internet. For information stored/transferred on externally accessible server we use secure https protocol.

Means BaccS provides to help users to follow GDPR requirements

BaccS provides the following functions to meet modern data security practices:

  1. Audit trail feature. This feature allows to track all changes made for customers and vendors stored inside your database. This allows to see who made particular change, when it was done and which data was changed (including data before change).
  2. Vendor portal. When you create a vendor in BaccS, you may allow him/her to log in into web-portal and change/erase own details.
  3. Customers’ batch change feature. This feature allows to clear all sensitive data for the selected customers, including name, address, contact details, names and e-mails of contacts, and other details.
  4. BaccS web-portal uses secure https protocol to protect data you’re viewing.

The rights of Users

Users may exercise certain rights regarding their Data processed by the Owner. In particular, Users have the right to do the following:

  • request an information about the way we use your personal data;
  • request all personal data we have about you;
  • ask to correct and/or delete your personal data;
  • withdraw consent where they have previously given their consent to the processing of their Personal Data;
  • restrict the processing of their Data
  • complain to your local data protection authority, or to a court of law, if your data protection rights are violated. You may be entitled to claim compensation for damages or distress incurred or suffered as a result of unlawful processing of your personal data.

You are not required by law to provide your personal data to us, however, in this case we won’t be able to generate license code or provide an access to a web-version.
